NOTICE OF PUBLIC SALE OF PREMISES AT 1 BATES COURT, GUILFORD, COUNTY OF PISCATAQUIS, STATE OF MAINE, REFERENCE BEING HAD TO MORTGAGE DEED OF BOOK 2295, PAGE 100, PISCATAQUIS COUNTY REGISTRY OF DEEDS
By virtue of and in execution of a Power of Sale contained in a certain mortgage deed given by 1 Bates St., LLC dated March 24, 2014 recorded at Book 2295, Page 100, Piscataquis County Registry of Deeds of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage, and for the purpose of foreclosing the same, there will be sold at public sale at the premises described in said mortgage, being at 1 Bates Court sometimes known as 1 Bates Street, in said Guilford, Piscataquis County, State of Maine at 2:00 p.m. on Friday, May 31, 2019 the real estate in said mortgage described as follows:-
“A certain lot or parcel of land, together with the buildings or improvements thereon, situated on the south side of the main highway leading from Guilford to Abbot on the south side of the Piscataquis River, in Guilford, County of Piscataquis and State of Maine, known as Elm Street, bounded and described as follows: Bounded on the north by said highway; south by land formerly owned by James H. Hudson and by land formerly owned by Otis Sylvester; east by Bates Court, formerly known as Elm Court; and west by land formerly of William Howard.
“Being the same premises conveyed by Chase Properties, Inc. to Tyson E. Cartwright by Warranty Deed dated July 3, 2008, and recorded in the Piscataquis County Registry of Deeds in Book 1933, Page 194. Being the same premises conveyed by Tyson E. Cartwright to 1 Bates St., LLC by Warranty Deed of even date to be recorded herewith.” [It may be noted that said deed was recorded at Book 2295, Page 98, Piscataquis County Registry of Deeds].
The sale shall be subject to any condition which a title search would reveal, any unpaid taxes or assessments, and any facts which an accurate survey of the premises might show. The sale shall also be subject to any condition which an examination or inspection including such condition as any engineering or environmental testing of the premises might reveal, condition of the premises to be “AS IS” with no warranties regarding condition, permitted use or value of the premises.
As a qualification to bid each prospective bidder shall be required to submit a bank or certified check payable to Franklin Savings Bank in the amount of $2,000.00 which will be returned if the bidder is unsuccessful, and which amount will be retained as a deposit upon the purchase price from the successful bidder. The balance on the purchase price shall be due in certified or cashier’s check within thirty (30) days after the time of sale. The purchaser shall be required to sign a memorandum of purchase at the time of sale. Additional terms will be announced at the sale.
